New Delhi, The Supreme Court has said that the court cannot make someone a victim of injustice to compensate for the injustice done to the victim of the crime. The Supreme Court made the remarks while acquitting a man sentenced to death for raping and murdering a six-year-old girl.
The court said that there are serious contradictions in the statements given by the prosecution witnesses and they have been thoroughly overlooked by both the trial court and the High Court. A bench of Justices S Abdul Nazir, AS Bopanna and V Ramasubramaniam also said in its order that the accused was so poor that he was not in a position to afford a lawyer to represent him in the sessions court.
The bench also criticized the prosecutor for not investigating the matter properly. The bench said that we do not overlook that fact. This is a horrific case of rape and murder of a six-year-old girl.
The prosecution has done injustice to the victim’s family by not investigating properly. The appellant was convicted without any evidence.HS1MS
