New Delhi, Supreme Court in an important hearing has said that it takes time to settle down after marriage, the decision to divorce only after 40 days is wrong. The Supreme Court made this very important finding clearly refusing to exercise its absolute power to annul a marriage under Article 142 of the Constitution.
In the case presented before the Supreme Court, the husband and wife lived together for only 40 days before separating. A bench of Justice Rajesh Bindal and Justice Arvind Kumar hoped that the husband and wife would come to their senses. The Supreme Court held that the newlyweds had lived together for only 40 days.
It takes time to settle down after marriage. The couple cited various fronts as the reasons for the breakup of the marriage. In this case, the wife alleged abuse from her in-laws.
After this incident, the husband sent her to Mumbai and broke all relations with her. After refusing to enter her in-laws, the wife lodged a complaint with the police. Meanwhile, the husband had also started the process of filing for divorce.
The husband, on the other hand, claimed that he had made several attempts to end the matrimonial dispute, including mediation. However, it was of no use. The Supreme Court rejected the plea to transfer the case keeping in view the marital status, this fact.
